Terms of Service

These Terms of Service (“Terms”) govern your use of punchi.tv and related services (the “Service”) provided by Ubersoft LLC, a Virginia limited liability company doing business as punchi(“punchi,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service, and old enough to form a binding contract where you live. To view or broadcast content marked 18+/mature, you must be at least 18 (or the age of majority in your jurisdiction). By using the Service you represent that you meet these requirements.
2. Your account
- Provide accurate information and keep it up to date.
- You are responsible for activity under your account and for keeping your credentials secure.
- You must verify your email address to chat or broadcast where email verification is enabled.
- Do not impersonate others or use a handle you do not have the right to use.
3. Content you provide and broadcasting rights
You retain ownership of the content you create, upload, or broadcast (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and distribute Your Content solely to operate and provide the Service (for example, delivering your live stream to viewers and showing your chat messages, emotes, and profile).
You may only broadcast, upload, or share content that you own or that you have all necessary rights and licenses to distribute. Streaming movies, shows, sports, music, or other material you do not have the rights to is strictly prohibited and may violate the law. You are solely responsible for Your Content and for obtaining any permissions it requires.
4. Acceptable use
You agree not to use the Service to:
- Harass, threaten, bully, defame, or incite violence against others.
- Post hateful, harassing, or obscene content, including slurs and the terms blocked by our community word filters.
- Infringe anyone's intellectual property, privacy, or other rights.
- Share sexual content involving minors, or any illegal content — this results in immediate termination and may be reported to authorities.
- Distribute spam, scams, malware, or attempt to evade moderation, bans, or filters.
- Disrupt, overload, reverse engineer, or gain unauthorized access to the Service.
5. Mature content
Channels may mark themselves as 18+/mature. You are responsible for accurately labeling your content and for complying with all applicable laws. Do not present mature content on a channel that is not marked accordingly.
6. Copyright and DMCA
We respect intellectual property rights and respond to notices of alleged infringement. If you believe content on the Service infringes your copyright, submit a notice through our Copyright / DMCA page. We may remove content and, consistent with our repeat-infringer policy, suspend or terminate accounts that receive repeated valid copyright complaints.
7. Moderation and enforcement
Channel owners, their moderators, and site administrators may remove content, delete messages, and time out, ban, suspend, or terminate accounts that violate these Terms or our community standards, with or without notice. We may also remove content or limit access at our discretion to protect users and the Service.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, in whole or in part, if you violate these Terms or if we reasonably believe it is necessary to protect the Service or others. Provisions that by their nature should survive termination will survive.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, and we are not responsible for content posted by users.
10. Limitation of liability
To the maximum extent permitted by law, punchi and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service.
11. Indemnification
You agree to indemnify and hold harmless punchi and its operators from any claims, damages, and expenses arising out of Your Content, your use of the Service, or your violation of these Terms or the rights of any third party.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
13. JABS and paid features
JABS are punchi’s in-app currency. You buy them from punchi and spend them on things punchi provides: power-ups, flair, and the channel features below. JABS aren’t money. They can’t be cashed out, transferred to another account or refunded as cash. Where a purchase below is refunded, it’s refunded in JABS to your balance.
You’re buying a feature from punchi, not making a payment to the streamer.
Paid requests. Streamers can list things you can ask for with JABS, like “pick my next game”. JABS are taken when you ask. If the streamer declines, or you withdraw while it’s still waiting, they come back to you. Requests must be things a streamer can do on stream: no real-world goods, meetups, or anything a subscription already includes.
Goal boosts. Boosts move a channel’s community goal in fixed amounts. A boost does its job the moment you buy it, so it isn’t refunded if the goal isn’t reached or the streamer ends it.
Bounties. You can put JABS on a challenge for a live streamer, and others can add to it. If the streamer completes it, the pot goes to them. If they don’t accept it within 10 minutes, don’t complete it, or the stream ends first, everyone gets their JABS back. Nobody wins anything from a bounty; it isn’t a bet. Challenges must be safe, legal and doable on stream. Moderators can cancel any bounty, and everyone is refunded.
Emote sponsorship. Sponsoring puts your name on one of a channel’s emotes for 7 days. If it’s already sponsored, your 7 days start when the ones ahead of you end. At most two people can wait for an emote, so the longest wait is 14 days, and you see your start date before you pay. It isn’t refunded if the channel later removes the emote.
Clip pins (retired). Pinning a clip to a channel’s shelf for JABS is no longer offered, as of September 26, 2026. Every pin still up then was taken down and its buyer refunded the JABS they paid for it. The Hall of Fame on punchi now lists supporters who donate to punchi and is not something you buy.
Streamer responsibilities. If you offer paid requests, accept bounties or upload sounds for sound drops, you’re responsible for that content and for doing what you accepted. You must have the rights to any sound you upload. punchi may remove anything that breaks these Terms, and refund the people who paid.
14. Channel points and games
Channel points are free. You earn them by watching and chatting. Subscribers earn points faster. A channel may give its points its own name. Points have no cash value. They can’t be bought, sold, exchanged for money or JABS, cashed out, or transferred outside punchi, and nobody may offer to buy or sell them.
The chat games (slots, blackjack, roulette, dice, duels and the others) are played with points only, and they’re for entertainment. Game winnings are points, and points never turn into money or JABS. JABS can’t be used in any game.
We may change how points are earned or spent, reset balances, or change or end any game at any time. If points were gained by cheating, automation or a bug, we may remove them.
Fight characters. Your first fighter is free and stays yours. Other characters cost channel points and are bought once: they’re yours on every channel, and switching between characters you own is free. Each character fights its own way, with its own ATTACK, DEFENCE, CRIT and LUCK. Every character has the same total, spent differently, so none is simply stronger than another. Characters can’t be bought with money or JABS. Like points, characters have no cash value and can’t be refunded, sold or transferred. We may change prices, the roster, or a character’s stats to keep fights fair, and if we remove a character you own, we’ll give you another of the same tier.
15. Subscriptions and cheers
Subscriptions. You can subscribe to a channel for a monthly price shown before you pay. A subscription renews automatically each month until you cancel. You can cancel at any time, and you keep your subscriber benefits until the end of the month you’ve paid for. A gifted subscription lasts one month and doesn’t renew.
Cheers. A cheer is a one-off payment to a channel, shown in its chat with your message.
Payments are processed by Stripe. Except where the law requires otherwise, payments for subscriptions and cheers aren’t refundable, including when a channel stops streaming or is removed. If a channel is removed, any subscription to it is cancelled and stops renewing.
